1. Who we are
These Terms of Service govern the use of the ClickNich platform and related services operated by Click Technologies LLC, a limited liability company registered in the State of Wyoming, United States, with registered office at 30 N Gould St, Ste R, Sheridan, WY 82801 ("Click Technologies", "we", "us").
By accessing the platform, creating an account or completing a purchase, you agree to these Terms. If you do not agree, do not use the platform.
2. The platform
ClickNich is a software platform for digital product creators. It provides page building, email automation, membership areas, content delivery, affiliate tracking, reporting and transaction processing.
Two categories of users exist on the platform:
- Creators publish digital products through the platform and receive commission payments on resulting sales.
- Customers purchase digital products made available through the platform.
3. Purchases
When a customer completes a purchase through the platform, the contracting party for that transaction is Click Technologies LLC. Payment is collected through licensed third-party payment providers. Card statements will show CLICKNICH as the descriptor.
Prices are displayed at checkout in the applicable currency and include any taxes required to be shown. Access to purchased digital content is delivered electronically, normally immediately after payment is confirmed.
4. Creator terms
Creators publishing products through the platform agree that:
- They hold all rights necessary to offer the content they publish.
- Their content and marketing materials comply with applicable law, including advertising and consumer protection rules.
- Commission is calculated on completed sales and paid according to the payout schedule selected in the creator's account.
- Click Technologies may withhold or reverse commission relating to refunded, disputed or fraudulent transactions.
- Click Technologies may remove content that violates these Terms or applicable law.
5. Acceptable use
You may not use the platform to:
- Publish or distribute unlawful, infringing, deceptive or harmful content.
- Make false or unsubstantiated claims about any product, including health, income or performance claims.
- Circumvent platform security, interfere with its operation, or access accounts belonging to others.
- Process transactions unrelated to the products published on the platform.
6. Accounts
You are responsible for the accuracy of the information in your account and for maintaining the confidentiality of your credentials. We may suspend or terminate accounts that violate these Terms, that present a security or compliance risk, or where required by law or by our payment providers.
7. Intellectual property
The platform, its software and its design are owned by Click Technologies LLC. Creators retain ownership of the content they publish and grant Click Technologies the licence necessary to host, display, market and deliver that content to customers.
8. Disclaimers and liability
The platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, our aggregate liability arising from or relating to these Terms is limited to the amount paid by you to Click Technologies in the twelve months preceding the event giving rise to the claim.
Digital products published by creators are educational or informational in nature. They do not constitute professional, medical, legal or financial advice, and no specific outcome is guaranteed.
9. Changes
We may update these Terms. Material changes will be announced on this page with an updated revision date. Continued use of the platform after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
